We hereby provide you with information about your rights related to the processing of your personal data by the administrator, which is the company State Medical Spa Janské Lázně, a state enterprise.

1. Who processes your personal data?

The personal data controller, i.e. the person who determines the purposes and means and decides on the processing of your personal data for the above-mentioned purpose, is the company State Medical Spa Janské Lázně, a state-owned company, with its registered office at náměstí Svobody 272, 542 25 Janské Lázně, ID: 00024007, registered in the Commercial Register maintained by the Chamber of Commerce in Hradec Králové under file number AXII 253

2. How and why is your personal data processed?

When processing personal data, we comply with the relevant legal regulations, in particular the General Data Protection Regulation ("GDPR").GDPR") and implementing legislation. The processing of your personal data is carried out in order to ensure all our and your rights and obligations arising in particular from legal regulations and contracts. When processing your personal data for this purpose, no automated decision-making or profiling takes place.

3. Which of your personal data do we process?

We only process personal data that we have obtained directly from you or from third parties for the purpose of fulfilling the contract between you and our spa, or for the purpose of fulfilling our legal obligation, or that you have provided to us based on consent for a specified purpose. We process your personal data only for the period strictly necessary for the specified purpose, which results from legal regulations, contracts, legitimate interest, or which was stated in your consent to the processing of personal data.

4. How do we protect your personal data?

You can be absolutely sure that we handle your personal data with due care and in accordance with applicable legal regulations. We are aware of the sensitivity of personal data, and therefore we protect your personal data to the maximum extent possible, which corresponds to the technical level of available means.

5. To whom else do we provide your personal data and why?

We may disclose your personal data to third parties providing support activities for us - in particular software management, only for the purpose of performing these activities. We may also transfer your personal data to third parties for processing to the extent necessary, but only if this is necessary to fulfill our contractual or legal obligation, or if you have given us your consent to do so. These third parties are then in the position of personal data processors and we only make available to them the personal data necessary for the given purpose and we ensure that they also consistently protect your personal data. We carefully select the personal data processors providing the above-mentioned activities, and we also continuously change and supplement them. Given these updates and changes, we are ready to provide you with an up-to-date list of such entities to which the transfer of your above-mentioned data is considered.

We do not transfer your personal data to other countries.

6. What rights do you have regarding your personal data?

In relation to your personal data that we process, you have the following rights that you can exercise against us as the controller:

  • the right to obtain confirmation of the (non)processing of your personal data and to access the personal data concerning you that we process;
  • the right to correct or supplement your personal data if it is inaccurate or incomplete;
  • the right to erasure or restriction of processing of your personal data, if the conditions set out in legal regulations are met (if a legal regulation requires us to store your personal data (e.g. medical records) for a certain period of time, unfortunately we cannot delete them during this period);
  • the right to object to the processing of personal data concerning you;
  • the right to transfer your personal data to another controller.

You can exercise your rights by submitting a written submission to our company address or to the company email address as specified in this information memorandum.

Given that we process some of your personal data based on your consent, you have the right to withdraw your consent to the processing of such personal data at any time, either by clicking the unsubscribe link in the newsletters sent or by sending an email to gdpr@janskelazne.com.

If you believe that the processing of your personal data is in violation of legal regulations, you have the right to file a complaint with the supervisory authority, which is: Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7, www.uoou.cz.

Following the Resolution of the Government of the Czech Republic No. 855 of December 17, 2018, by which the Government of the Czech Republic approved the government's concept for combating corruption for the years 2018 to 2022, and the Order of the Minister of Health of the Czech Republic No. 22/2019, the spa management implemented the following anti-corruption measures.

An anti-corruption hotline has been established with the number + 420 499 860 107 and email address anti-corruption@janskelazne.com, used for reporting suspected corrupt practices related to the activities of the State Medical Spa Janské Lázně. You can also report suspected corrupt practices in person or by letter addressed to the spa's deputy economic officer. The report can also be submitted anonymously and there is no prescribed form. However, it will help us if you indicate the person suspected of committing the misconduct, a description of such conduct and references to specific evidence. We record and thoroughly investigate all received reports. If you provide us with your contact details, we will inform you of the outcome of the investigation of your report.

2. Reason and method of establishment

The State Health Spa Janské Lázně (hereinafter referred to as "SLL JL") is a state enterprise established by the Ministry of Health and Social Affairs on 1 July 1990 to meet public benefit interests. The purpose for which the enterprise was established is to provide health services of spa medical rehabilitation care, in which the enterprise primarily uses local natural healing resources, and medical rehabilitation care in the form of inpatient follow-up care, at the level of the latest scientific medical knowledge. The basic business activities of SLL JL are the provision and provision of spa rehabilitation care and medical rehabilitation care in the form of inpatient follow-up care for patients in specified indications according to the relevant regulations to the extent determined by the founder and the administration and use of natural healing resources in cooperation with the Czech Inspectorate of Spas and Springs, including their protection.
The founder is the Ministry of Health of the Czech Republic.

SLL JL is guided by the applicable legal regulations and internal company regulations in its activities. The basic legal regulations relating to the activities of SLL JL include Act No. 372/2011 Coll. on health services and conditions for their provision (Act on Health Services), Decree No. 2/2015 Coll. on the establishment of professional criteria and other requirements for the provision of spa medical and rehabilitation care, and Act No. 77/1997 Coll. on state-owned enterprises.

6. Requests for information pursuant to Act No. 106/1999 Coll.

In accordance with Act No. 106/1999 Coll., on Free Access to Information, as amended (hereinafter referred to as the “Act”), any natural or legal person may submit a request for the provision of information (hereinafter referred to as the “Request”). The request may be submitted to SLL JL orally or in writing.
The applicant shall submit an oral application either in person at the secretariat of the director of SLL JL, nám. Svobody 272, 542 25 Janské Lázně or by telephone at 499 860 103, with the relevant SLL JL employee being able to request the applicant to submit the application in writing.

A written request can be submitted:

Requirements for a request for information pursuant to Act 106/1999 Coll.:

The application must indicate to which obliged entity it is addressed and that the applicant is requesting the provision of information within the meaning of this Act. A natural person shall state in the application their name, surname, date of birth, address of permanent residence or, if not registered for permanent residence, their residential address and delivery address, if different from the address of permanent residence or residence. A legal person shall state their name, identification number, registered office address and delivery address, if different from the registered office address. The delivery address also includes an electronic address.

Processing of a request for information pursuant to Act 106/1999 Coll.:

The application is submitted on the day it is received by the obliged entity. If the applicant's application is incomplete or incomprehensible, SLL JL will invite the applicant within 7 days from the date of submission of the application to supplement or clarify the application; if the applicant does not comply with this invitation within 30 days from the date of its delivery, SLL JL will postpone the application in case of its incompleteness or reject the application in case of its incomprehensibility. If the requested information does not relate to the scope of SLL JL, SLL JL will postpone the application and communicate this justified fact to the applicant within 7 days from the date of delivery of the application.

Remedies in proceedings pursuant to Act 106/1999 Coll.:

A. complaint:
The applicant may file a complaint about the procedure for handling a request for information through SLL JL. The complaint may be filed orally or in writing. If the complaint is filed orally and cannot be handled immediately, SLL JL shall make a written record of it. The complaint may be filed within the time limit and for the reasons set out in the Act (provision of Section 16a of the Act). The Ministry of Health of the Czech Republic shall decide on the complaint within 15 days from the date on which it was submitted to it. The superior authority shall review the procedure of the obliged entity and decide by confirming the procedure of the obliged entity, or by ordering the obliged entity to handle the request within the specified time limit, or by taking over the matter by resolution and providing the information itself, or by issuing a decision to reject the request.

B. appeal:
The applicant may file an appeal against the decision of the SLL JL to reject the application or part thereof with the superior authority (Ministry of Health of the Czech Republic) within 15 days from the date of delivery of the decision of the SLL JL to reject it. An appeal against the decision of the SLL JL is filed with the Ministry of Health of the Czech Republic through the SLL JL, Director's Secretariat, at the address State Medical Spa Janské Lázně, state enterprise, nám. Svobody 272, 542 25 Janské Lázně. The appeal against the decision of the SLL JL to reject the application or part thereof shall be submitted by the SLL JL together with the file material to the superior authority (Ministry of Health of the Czech Republic) within 15 days from the date of its delivery. The superior authority shall decide on the appeal within 15 days from the date of submission of the appeal by the obliged entity (in this case, the SLL JL).

C. lawsuit:
During the judicial review of the decision of the superior authority (Ministry of Health of the Czech Republic) on appeal based on a filed lawsuit under a special legal regulation, the court will examine whether there are grounds for rejecting the application. If there are no grounds for rejecting the application, the court will annul the decision on appeal and the decision of the obliged entity to reject the application and order the obliged entity to provide the requested information.
